1) Introduction
These Terms of Service ("Terms") govern your access to and use of Lodd (the "Service"). By using the Service, you agree to be bound by these Terms.
2) Definitions
- Account: Your organization or individual subscription to the Service.
- Site: Any domain or application where you install our tracking script.
- View: Counted when our client tracking script records a
page_viewevent. One count per page load or SPA route change that triggerspage_view. Excludes known bots/crawlers and automated headless traffic (user agent filtering and heuristics). A 5-second debounce suppresses accidental double fires. Prefetch/prerendered loads don't count unless the script executes and emitspage_view.
3) Plans, Usage Limits, and Fair Use
- Monthly cap: Accounts include up to 100,000 events per calendar month (UTC) aggregated across all Sites under the Account.
- Aggregation: Usage is aggregated across all Sites connected to the Account.
- Measurement window: Monthly usage is measured in UTC and resets at 00:00:00 on the 1st of each month.
- Measurement method: Counting method, bot filtering, debounce, and SPA routing as defined under View.
- Sampling: We may apply sampling if usage substantially exceeds plan thresholds to maintain service quality and stability.
4) Exceeding the Monthly Cap
- Soft cap (default): Tracking continues and overage fees apply for usage above the cap.
- Notifications: We will email alerts at 80%, 100%, and 120% of the monthly cap.
- Optional hard cap: Account owners may enable a setting to stop tracking once the cap is reached; this may impact analytics completeness.
- Chronic overuse: Failure to pay overages or repeated excessive usage may result in rate-limiting, suspension, or termination per Section 10.
5) Fees, Billing, and Taxes
- Overage fees: Charged at the then-current rate per additional 1,000 views above the monthly cap. Fees are non-refundable once service is delivered.
- Invoicing: Billed monthly based on measured usage in UTC. Taxes added where applicable.
- Disputes: Report billing disputes within 30 days of invoice date; we will review logs and adjust if warranted.
6) Acceptable Use
You may not circumvent limits, manipulate counts, generate artificial traffic, or use the Service for unlawful content or purposes. We may suspend the Service for abuse.
7) Data, Privacy, and Security
We collect limited event data to provide the Service. See our Privacy Policy. You are responsible for obtaining any required consents and honoring user choices and applicable laws.
8) Service Levels and Changes
We do not guarantee uptime unless specified elsewhere. We may update features or policies; material changes to these Terms will be communicated.
9) Intellectual Property
We retain ownership of the Service. You retain ownership of your content and any insights derived from your data.
10) Term, Suspension, and Termination
We may suspend or terminate your Account for non-payment (including overages) or abuse. Upon termination, you may export your data subject to our retention limits.
11) Limitation of Liability; Disclaimer
To the maximum extent permitted by law, the Service is provided "as is" and our liability is limited as permitted by applicable law.
12) Governing Law; Dispute Resolution
These Terms are governed by applicable law as determined by our place of establishment. Disputes will be resolved in the specified courts of that jurisdiction unless otherwise required by law.
